Lee C. Burkins appeals from the decision of the United States Court of Federal Claims that granted summary judgment in favor of the United States in Mr. Burkins suit challenging the decision of the Army Board for Correction of Military Records ("ABCMR" or "Board") that denied Mr. Burkins request for correction of his military records. Mr. Burkins had asked the ABCMR to correct his military records to show (i) that he was unfit for military service because of post-traumatic stress disorder ("PTSD") when he was discharged on November 4, 1970 and (ii) that he had received a disability discharge on that date. The ABCMR determined that there was no evidence that Mr. Burkins should have received a disability discharge on November 4, 1970, but determined that he was 50% disabled from PTSD as of March 18, 1987. The ABCMR recommended that Mr. Burkins records be changed to show that he received a disability discharge on March 18, 1987 and was permanently retired with entitlement to retirement pay as of March 19, 1987. Mr. Burkins appealed to the Court of Federal Claims, which granted summary judgment to the United States, upholding the Boards decision. See Burkins v. United States, No. 97-755C (Mar. 3, 1999) (order). We affirm.
